Terms Of Service

The Below Terms Of Service (TOS) act as a binding contract between you (The Client) and Haney Hayes Promotions (HHP). 


Initial Payment of your invoice is acceptance of the conditions herein and shall serve as a binding agreement between the client and Haney Hayes Promotions (HHP). All transactions are subject to a Service fee. 

All Sales are Final and may only be disputed within ten (10) days of initial payment.

We at HHP (Haney Hayes Promotions) Pledge to our clients that we are 100% dedicated to Human Created Content. We will diligently work to continue to offer Graphic Designs WITHOUT the use of Generative AI software. Our team believes in 100% transparency in our practices and believes that until there is an ethical and regulated usage by law and practice in regard to AI products, we will not use them or promote them in any way, shape, or form.

HHP reserves the right to terminate services at their discretion, with or without causation, such as but not limited to a conflict of interest, hypocrisy, social injustice, or ethical ambiguity. 

All original documents and information within the HHP Google Drives belong to HHP and, therefore, may not be reproduced or transferred. The information you provide will be used for promotional and marketing purposes and will not be shared with any third-party vendor. As stated, the content provided is yours except in the event that you cannot pay for the services outlined in the invoice. In the event of a failure to pay, the finished product/s (IE) edited and formatted manuscript and/or any other material/s created by HHP will be withheld until payment has been made. If a project is published before the final payment (this does happen) and payment is not made, then HHP has the right to request the material/s be unpublished as services provided have not been successfully purchased. Any design created by HHP shall not be shared or otherwise distributed until the finalization of the product; this includes public critique groups or any other outside source without prior permission from HHP. This clause protects all intellectual property in the event of changes or termination of services. Failure to comply results in added charges for materials used, as they will no longer be viable for any other usage. This includes but is not limited to original images, logos, and designs created or procured by HHP. All design work, formatting, or editing requires a 1/3 down payment to begin the project, which will be applied to the final cost of the project. 

For Covers:

Upon Receipt of Payment, HHP is obligated to send you (the buyer) the following information: 1 Full wrap book cover, 1 e-book cover, 1-3 3d book images, 1 banner, 1 Social Media Graphic compatible with most platforms, 3 teasers, which the buyer may reproduce in whole or part so long as it is linked back to the seller @www.haneyhayespr.com 

**Covers come with basic licensing. We can provide you the direct asset links for extended merchandising usage per image for Stock if required. There is also a  $150 + Tax for original art-(This is accompanied by a signed release upon payment fulfillment). 

Any additional fonts or images used may be subject to additional costs to the client, where applicable. It is the client's responsibility to ensure any provided materials are properly copyrighted, trademarked, or licensed before being transferred to HHP for use. We are Amazon Affiliates and may make a small percentage on any link we provide. In the event that affiliate links are not to be used or are replaced by the client, a cost of $150 USD  is added to each month of service. In the event of early termination of a long-term service or changing of services, payments must be up to date for the release of any material created by Haney Hayes Promotions. These include but are not limited to graphic designs, formats, edits, and magnets. Changing services, mid-contract nullifies any and all discounts, and the client is responsible for bringing all invoices current with any added prorated costs for completed work. 

Failure to fulfill payment obligations may result in termination of services, denial of future services, and possible legal action to reconcile any remaining balances. As stated, payment is acceptance of these terms and conditions. Any changes or terminations of services must be in writing and be submitted no later than one week prior to the end of any billing cycle so as not to sustain further charges.

HHP gathers personal information from users of the Sites. When you browse our Sites, subscribe to our services, or contact us through various social or web forms, you are voluntarily sharing personal information with us. This personal information also includes various data that we collect automatically. This may be the user’s Internet Protocol (IP) address, operating system, browser type, and the locations of the Sites the user views right before arriving at while navigating and immediately after leaving the Sites. HHP reserves the right to transfer all information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or a portion of HHP’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred information will be subject to this Privacy Notice or to a new privacy notice if you are given notice of that new privacy notice and are given an opportunity to affirmatively opt-out of it.

3. DO WE SHARE YOUR PERSONAL INFORMATION?

General Provisions


HHP contractually prohibits its contractors, affiliates, vendors, and suppliers from disclosing any personal information received from HHP other than in accordance with this Privacy Notice. HHP declares that it will not share any personal information with any third party unless agreed to in writing by you. HHP neither owns nor controls the third-party websites and applications accessible through the Sites. Thus, this Privacy Notice does not apply to personal information provided to or gathered by the third parties that operate them. Before visiting a third party or using a third-party application, whether by means of a link on the Sites, directly through the Sites, or otherwise, and before providing any personal information to any such third party, users should inform themselves of the privacy policies and practices (if any) of the third party responsible for those Sites or applications and should take those steps necessary to, in those users’ discretion, protect their privacy. 

Analytics

We may partner with selected third parties to allow tracking technology on the Sites, which will enable them to collect data about how you interact with the Sites and our services over time. This personal information may be used to, among other things, analyze and track data, determine the popularity of certain content, and better understand online activity.

4. PRIVACY RIGHTS - CALIFORNIA USERS


If you are under 18 years of age


If you have a registered account with HHP, you have the right to request the removal of unwanted personal information that you publicly post on our Sites. To request the removal of such information, please contact us using the contact information provided here. Make sure to include your account's email address and a statement that you reside in California.

"Shine the Light Law"

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, personal information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this personal information would include a list of the categories of the personal information that was shared and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in digital writing to the address listed here.


5. CHILDREN


Children are not permitted on the HHP site as some content extensions may not be suitable for those under the age of 18+.

The Children's Online Privacy Protection Act ("COPPA") protects the online privacy of children under 13 years of age. However HHP does not knowingly collect or maintain personal information from anyone under the age of 18+  unless or except as permitted by law. Any person who provides personal information through the Sites represents to us that he or she is 18 years of age or older. If we learn that personal information has been collected from a user under 18 years of age on or through the Sites, then we will take the appropriate steps to cause this personal information to be deleted. If you are the parent or legal guardian of a child under 18 who has become a member of the Sites or has otherwise transferred personal information to the Sites, please contact HHP using our contact personal information here to have that child's account terminated and personal information deleted.


6. DO-NOT-TRACK NOTICE 


Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. The Sites currently do respond to DNT browser signals or mechanisms.


7. GOVERNING LAW


Disputes over privacy issues contained in this Privacy Notice will be governed by the law of the State of Ohio. You also agree to abide by any limitation on damages contained in our Terms of Service or other agreements that we have with you.


8. PRIVACY NOTICE CHANGES


HHP may, in its sole discretion, change this Privacy Notice from time to time. Any and all changes to HHP’s Privacy Notice will be reflected on this page, and the date of the new version will be stated at the top of this Privacy Notice. Unless stated otherwise, our current Privacy Notice applies to all personal information that we have about you and your account. Users should regularly check this page for any changes to this Privacy Notice. HHP will always post new versions of the Privacy Notice on the Sites. However, HHP may, as determined in its discretion, decide to notify users of changes made to this Privacy Notice via email or otherwise. Accordingly, it is important that users always maintain and update their personal contact information.
